Cuttack: The Orissa High Court here on Monday will begin the hearing on Anjana Mishra’s petition filed in 2002 on the CBI’s alleged failure to arrest Biban Biswal and tardy progress in the probe.
The case has been listed for hearing in the court of Chief Justice S Muralidhar.
While two accused have been sentenced to life imprisonment, Biban was arrested last week by Odisha police.

The incident took place on January 10, 1999. Two days later, the case was handed over to the Crime Branch. Police seized the scooter used by the miscreants and arrested Pradip Sahoo alias Padia and Dhirendra Mohanty alias Punia on January 26.

On February 26, 1999, the HC had ordered a CBI probe into the incident after police failed to nab the prime accused Biban.
On June 24, 2010, the HC had expressed displeasure over the police’s inability to arrest the prime accused while upholding the life imprisonment sentence for the two accused.

“I am surprised that the case has been listed for Monday after so many years. I had filed the petition in August 2002. The HC had also issued a notification to the CBI. Though it was listed a few years ago, the case was not heard,” senior lawyer Bibhu Prasad Tripathy was quoted as saying by The Times of India.
