Cuttack: The Orissa High Court has dismissing a petition against cancellation of grant of lease on government land to a woman in Bhubaneswar, observing that courts of justice should not be allowed to be polluted by unscrupulous litigants by resorting to extraordinary jurisdiction.
The court made the observation during a recent judgment while considering the petition seeking quashing of an order in which an additional district magistrate (ADM) had cancelled grant of lease on two acres of government land to a woman at Andharua in Bhubaneswar.
“It is of utmost importance that in making material statements and setting forth grounds in writ petition seeking such relief, care must be taken not to make any statements which are inaccurate, untrue, and misleading,” the HC said.
The lease order had been cancelled by the ADM on finding that government land had been settled by the tehsildar owing to fraud and misrepresentation.
After the death of the woman, her sons had filed a petition challenging cancellation of the leasehold granted in favour of their mother.
Dismissing the plea, the two-judge bench of Justices B R Sarangi and M S Raman said that while dealing with the writ petition, the court naturally takes statements of fact and grounds of fact contained in the petitions at their face value and it would be unfair to betray the confidence of the court by making statements which are untrue and misleading.
