Bhubaneswar: After a court in Bhubaneswar on Monday rejected the bail application of Archana Nag, who was arrested on extortion charges, her lawyer said they would appeal in a higher court.
Speaking to media persons, the lawyer said they had applied for bail in Sub-divisional Judicial Magistrate (SDJM) court in Bhubaneswar on the ground that several sections were not applicable in this case. But the court rejected the application.
“We will appeal in higher court as per the legal procedure. The court rejected the bail on certain grounds. We will look into those grounds and move the upper court,” he said.
“There is no basis for the allegations made against the applicant. Archana has been framed as per pre-planned ‘scripted note’. Most of the allegations are circumstantial which can be challenged and would be untenable in court. We will challenge the decision at an appropriate forum,” he added.
It may be noted that Archana was arrested on October 6 on charges of honey-trapping several influential people and extorting money from them. The court had reserved its verdict after concluding the hearing in her fresh petition for bail on October 14 when she appeared via video conferencing from Jharpada Special Jail here.
Her lawyer applied for bail stating that several sections, especially 354 (assaults or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will thereby outrage her modesty), were not applicable to her and she was a victim of political controversy.
