Berhampur: The DNA report has come to the rescue of Deepika, who has been hogging headlines for staging ‘dharna’ in front of her boyfriend’s house at Desi Behera Sahi in Bada Bazaar area in Odisha’s Berhampur since last year.
The report has revealed that Dinesh is the biological father of Deepika’s son.
Her lawyer, Deepak Pattanayak, told the media that the DNA report has authenticated Deepika’s claim. “The Supreme Court’s ruling clearly states that a child born from live-in relationship is not be treated as illegitimate and therefore, Dinesh has to pay for his maintenance. The JMFC court had earlier rejected our petition and we have moved the Orissa High Court, challenging the order,” he said.
In Vidyadhari v. Sukhrana Bai it was held by the top court that as per section 16 of the Hindu Marriage Act children born out of a live-in relationship should be given the status of ” legal heirs ” and are entitled to the right to inherit the property of both the parents.
Deepika, on the other hand, alleged that Dinesh’s family has been trying to cover up their entire matter. “I want the trial in my case to begin and justice delivered to my child,” she said.
Notably, Deepika began her sit-in protest with her baby boy in August last year after coming to know about Dinesh’s wedding plans with another woman. She staged a dharna, demanding acceptance as Dinesh’s wife, for 70 days. She resumed her protest at the same place again from August 8. Two days later, she claimed that Dinesh’s mother and grandmother threw chilli powder and water at her. Following which, she lodged a complaint with the Berhampur City SP and sought justice. A notice was then issued to the duo.
Speaking about the development, the SP had then said that a copy of the DNA report will be given to Deepika as she has sought the same.
