New Delhi: In a major development, the Centre has decided to revoke Article 370 and 35 (A), which offers special status to Jammu and Kashmir.
A resolution to this respect was introduced in the Rajya Sabha by Home Minister Amit Shah on Monday amid ruckus in Parliament and rising tension in Jammu and Kashmir.
J&K will be “reorganised geographically”, he said.
J&K will now be only a union Territory with legislature and Ladakh a UT without legislature. Law and order will remain with the Centre. Shah has moved a Bill in the House for bifurcation of the State. While Jammu and Kashmir will have a legislature, Ladakh will not have a legislature.
The decision has been taken keeping in view the prevailing security situation, he added.
Shah said that all provision of Article 370 will be considered null and void as soon as the President gives his assent to the proposal and the notification will be made available on all platforms.
What The Presidential Order On 370 States
Everything in the Indian Constitution will apply to Jammu and Kashmir and the Constituent Assembly in Article 370 (3) has been changed to the legislative assembly. This, in turn, means that the Governor, who is being treated as the ‘State’ govt at the moment, was able to move the resolution to the President.
The Presidential order means all central acts will now also be applicable to Jammu and Kashmir.
According to reports, Prime Minister Narendra Modi is slated to address the issue on August 7.
