Married Daughters Now Eligible For Govt Jobs Under Deceased Dependent Quota In UP

Lucknow: In a landmark decision, the married daughter of a government official who dies during his service will now be entitled to government jobs from the deceased dependent quota in Uttar Pradesh. The decision of the Personnel Department was approved by Chief Minister Yogi Adityanath-led Cabinet on Wednesday.

As of now, only sons, married sons and unmarried daughters get jobs on compassionate grounds under the deceased dependent quota. Families who have only one married daughter have been finding it difficult to get a job.

It was also agreed to amend the old system that married daughters should also be included in the definition of family, Hindustan Times reported.

Earlier this year, the Allahabad High Court said the exclusion of married daughters from the definition of “family” in the rules for appointment on compassionate grounds was unconstitutional and violative of Articles 14 and 15 of the Constitution. The Centre has also included married daughters in the definition of “family”.

While hearing a petition in January, the High Court held that a married daughter was no less eligible for government jobs on compassionate grounds than her married brother or unmarried sister.

The court was hearing a plea by one Manjul Srivastava, challenging a June 2020 order of Prayagraj’s district basic education officer, rejecting her claim to the appointment on compassionate grounds following her father’s death during his service to the state government.
