No Public Holiday On Netaji’s Birthday, Says Supreme Court

New Delhi: There won’t be a national holiday on the birth anniversary of Netaji Subhas Chandra Bose and the day will not be observed as Parakram Diwas, said the Supreme Court of India on Monday, dismissing a public interest litigation (PIL) for the same.

A bench of Chief Justice of India DY Chandrachud, and Justice JB Pardiwalla said that the plea was nothing but a mockery of PIL jurisdiction and said that the matter fell under the jurisdiction of the Government of India and not the apex court, Bar&Bench reported.

“This is a matter for Government of India. What will Supreme Court Do? Take jurisdiction of the court seriously. You are also a lawyer,” the Court said.

The counsel for the petitioner asked the Court why the day could not be celebrated when other days like Children’s Day and Buddha Purnima are celebrated in the country. The Court suggested celebrating the day by working hard the way Bose worked for independence, instead of seeking a holiday. Stating that the petitioner was making a mockery of the PIL jurisdiction, it dismissed the petition.

“You can celebrate it by working hard just like how he worked hard for independence…You are making a mockery of the PIL jurisdiction. You like blue skies and then you will come in PIL saying you want blue skies? At least think what the court can do….The 3 minutes that we spent on your petition could have got relief for another litigant you see. Sorry dismissed,” it stated.
