Bhubaneswar: The Odisha Real Estate Regulatory Authority (ORERA) has scrapped a land deal near Bhubaneswar over alleged violation of the provisions of Odisha Real Estate (Regulation and Development) Act, 2016.
According to sources, a landowner had created around 20 sub-plots of about an acre of land in Balianta area on the outskirts of the capital city without registering the bigger plot with ORERA. The fragmented sub-plots were being sold to multiple buyers, TOI reported.
Plots larger than 500 square metre need to be registered with ORERA. As per the rules, no promoter is allowed to advertise, market, book, sell or offer for sale or invite persons to purchase in any manner any plot, apartment or building in any real estate project or a part of it in any planning areas without registering the project with ORERA.
In this case, the landlord not only violated the ORERA norms, but also allegedly tried to sub-plot the chaka (a compact parcel) land, which is restricted under the Orissa Consolidation of Holdings and Prevention of Fragmentation of Land Act of 1972.
While hearing the plea of an aggrieved proposed buyer, ORERA asked the landowner to obtain layout plans for the plots from the competent authority within two months and then register them with the authority within 45 days.
ORERA also cancelled the sale deeds of the sub-plots concluded with the buyers till the registration is obtained.
This apart, ORERA also directed the inspector general of registration, Cuttack, and Khurda district collector to initiate action against sub-registrar of Balianta and his predecessor for executing the sale deeds in violation of the rules.
