ORERA Stays BDA Housing Project In Bhubaneswar; Know Why

Bhubaneswar: The Odisha Real Estate Regulatory Authority (ORERA) has stayed a housing project of the Bhubaneswar Development Authority (BDA) in the state capital and sought a reply on why the registration certificate (RC) of the project should not be revoked.

ORERA stayed the project on grounds of non-compliance of Real Estate (Regulation and Development) Act 2016 norms and suppression of material facts, a TNIE report said. BDA will have to comply with the showcause notice by October 11, when the matter will be heard next, the report said.

In its interim order, ORERA observed that in the absence of a format of ‘agreement for sale’ as per the provisions of Odisha Real Estate (Regulation and Development) Rules 2017, the promoter cannot continue the process for selection of allottees by receiving the booking amount, the TNIE report said.

ORERA also pointed out that as per RERA norms, submission of proforma of the allotment letter, agreement for sale and conveyance deed proposed to be signed by the allottees is mandatory to obtain registration, the report said.

According to the report, BDA took approval and registration certificate for the project on the basis of a mere brochure which is contrary to RERA norms.

The order pertains to BDA’s Rs 44 crore ‘Daya Enclave’ project in Bhagabanpur mouza.

ORERA’s order came on a petition filed by activist Bimalendu Pradhan on September 16.
