Panel Comprising PM, Leader Of Opposition And CJI Should Appoint Chief Election Commissioner: Supreme Court

New Delhi: The Supreme Court on Thursday ruled that the Chief Election Commissioner and Election Commissioners should be appointed by the President on the recommendation of a committee comprising the Prime Minister, leader of the Opposition and the Chief Justice of India.

A five-judge constitution bench headed by Justice KM Joseph said that if LoP is not there, then the leader of the single largest opposition party in Lok Sabha will be in committee to appoint the ECs and CEC. The court added that the norm will continue to hold good till a law is passed by Parliament.

As of now, the CEC and ECs are appointed by the President to a tenure of six years, or up to the age of 65 years, whichever is earlier.
