Bhubaneswar: The state government has finally notified the Odisha Apartment Ownership (Amendment) Rules 2021 to pave way for the formation of apartment owners associations in the state.
This comes as a significant move as it will allow transfer of ownership of land and the common areas of the housing projects to apartment owners association according to the provision of the Real Estate (Regulations and Development Act) 2016, the Federation of Odisha Apartments Associations members said.
The rules have been formulated after 39 years after the Apartment Ownership Act was put in place. The Odisha Apartment Ownership Act came into existence in 1982 and the rules were first framed in 1993 under the Act.
The provision of registration of association though was not included in it. The Odisha government later amended the Act in 2015 to draft in the provision in Section 12 (j-a) of the Act. The rules for implementation were never framed.
