New Delhi: In a scathing order, Supreme Court on Monday directed authorities to start demolition of the 40-storeyed Supertech Emerald Court twin towers in Noida.
Justices DY Chandrachud and Surya Kant also asked the Noida CEO to convene a meeting of all concerned agencies within 72 hours, PTI reported.
“The CEO Noida shall take all necessary steps for observing directions of this court, work of demolition shall commence no later than two weeks from this order,” the two-justice bench said.
The apex court had, on January 12, pulled up the builder for not complying with its orders to demolish the twin towers in Sector 93 of Noida and warned that the directors will be sent to jail for playing “truant” with the court.
Earlier, Justices Chandrachud and MR Shah had upheld a 2014 Allahabad HC judgment which ordered demolition of the two towers and wanted the demolition to be completed within three months. It wasn’t complied with.
The resident welfare association (RWA) had moved court alleging several violations and misrepresentations by the developer in building the twin towers. The RWA also wanted permission granted to link the two towers through a space frame to be set aside by the court.
Supertech argued that the two towers were sanctioned in accordance with Noida Building Regulations, 2006.
The Allahabad High Court, however, raised issues with the way the two buildings had been constructed. The high court also brought up rights of other residents in terms of “ventilation, light and air and adherence to fire safety norms”.
The Supreme Court further ordered the developer, Supertech Limited, to refund to all flat purchasers the amount invested along with an interest of 12% per annum within a period of two months.
