Swati Maliwal Assault Case: Bibhav Kumar Moves Delhi High Court To Declare His Arrest Illegal

New Delhi: Delhi Chief Minister Arvind Kejriwal’s aide Bibhav Kumar on Wednesday moved the Delhi High Court urging the court to declare his arrest by Delhi police as illegal.

Kumar’s lawyer pleaded that his arrest was in violation of the provision of Section 41A of the Code of Criminal Procedure and he should be paid compensation for that. He said it was a deliberate and blatant violation of the provisions of law.

Kumar’s lawyer urged the bench comprising Acting Chief Justice Manmohan and Justice Manmeet PS Arora to list the plea for an urgent hearing on Thursday.

The High Court agreed to hear a plea on Friday, Hindustan Times reported.

The Delhi CM’s close aide was arrested on May 18 following an FIR lodged against him on May 16 under various provisions of the Indian Penal Code. He was sent to police custody for five days.

Last Friday, he was sent to four days judicial custody. On Tuesday, the Delhi Police was granted three days for custodial interrogation of Kumar.
