Woman Gets Four-Year Jail Term For Abandoning Newborn

New Delhi: A sessions court here has sentenced a woman to four years of imprisonment for abandoning her 16-hour-old baby, who died later, in 2016.

According to a report in The Times of India, the 35-year-old woman was charged for ‘culpable homicide not amounting to murder’ since she knew that the infant wouldn’t survive if abandoned.

“Even if the child was illegitimate, it was the duty of the convict, being his mother, to bring him up. Instead of performing her duty, she preferred to throw him on the garbage heap like a non-living thing. At the same time, the court cannot be oblivious of the education, income and social status of the convict,” additional sessions judge Naveen Gupta was quoted as saying in the report.

One Noor Hasan had rescued the baby from a garbage dump on April 16, 2016, in a bad state of health and called the police. The baby was taken to a hospital but could not survive.

The woman had accused the father of the baby for the act, but could not produce any evidence that the latter was present with her at the time of the birth of the child or that she had called him after giving birth, the TOI report added.
