Child Adoption: Marriage Certificate Not Required, Says HC

Allahabad: A marriage certificate is not required for adopting a child, the Allahabad High Court asserted.

The two-member bench, comprising Justice Vivek Varma and Justice Dr Kaushal Jayendra Thaker, was hearing a writ petition filed by transgender Rina Kinnar and her spouse, observed that even a single parent can adopt a child as per Hindu Adoption and Maintenance Act of 1956.

Rina, born in 1983, got married to a man on December 16, 2000 at Varanasi. The couple wanted to adopt a child only to be informed that they needed to provide a marriage certificate under the Hindu Marriage Act which they did not have, PTI reported.

The transgender woman and her spouse filed an application with the Sub-Registrar, Hindu Marriage, Varanasi district, in December 2021 to evaluate and decide on their online marriage application, Live Law reported.
