Orissa High Court Exonerates Former ASP Of Bigamy Charges

Cuttack: The Orissa high court has reportedly exonerated a former additional superintendent of police (ASP) of bigamy charges for which his pension and gratuity was withheld after suspension for three years and seven months till his superannuation in 2007.

In High Court in a recent order reportedly declared retired ASP Nilamani Tripathy not guilty of bigamy charges.

“Only when the person who has been alleged of doing a misconduct or any act has contended differently and the person who alleged had discharged his or her burden, then the onus would shift to the person who has been alleged of doing some misconduct, to prove his contention, otherwise not,” the two-judge bench of Chief Justice Subhasis Talapatra and Justice Savitri Ratho ruled in its order on September 5, TOI reported.

Tripathy had challenged the judgment of State Administrative Tribunal (SAT) which ruled he was not entitled to get any relief against the disciplinary authority’s order that had withheld his pension and gratuity.
