Jaipur: Ten years after being accused of raping a minor, former IAS officer B B Mohanty was recently acquitted by a local metropolitan POSCO court here.
The court observed that the victim was not minor at the time of incident. She was well aware of her well being. The girl could have been registered her dissent soon after the incident but she preferred not to record it.
It further said that the prosecution could not prove that Mohanty had forcibly raped her. “This shows that the victim would have entered into relationship willingly with BB Mohanty. In such circumstances, no case is found against BB Mohanty,” it added.
The case dates back to January 25, 2014 when a 23-year-old MBA student filed a complaint at Mahesh Nagar police station, accusing Mohanty of sexually exploiting since February 2013. She claimed that she was raped for the first time at a flat occupied by the official on February 19, 2013. She claimed that Mohanty had promised to help her to clear the civil services exam.
Soon after the case was filed, the 1977-batch IAS officer of Rajasthan cadre fled from Jaipur. He surrendered before the police on November 20, 2017, after a court declared him a fugitive and started the process of confiscating his property. At the time of the incident, Mohanty was additional chief secretary rank officer and was posted as chairman of the Rajasthan Civil Services Appellate Tribunal.
After the complaint, Mohanty was suspended from the post. He evaded arrest for more than three years and even retired while being on the run.
