Mumbai: Arguing for the bail of Shah Rukh Khan’s son Aryan at Esplanade magistrate court, his lawyer Satish Maneshinde said that the 23-year-old had no prior antecedents and the chats that the Narcotics Control Bureau has been referring to took place when he was abroad.
Maneshinde contended that being a local boy, he should be granted bail. “I have parents and a family here. I have an Indian passport and I am not going to abscond. There is no question of tampering,” Aryan told the court through his lawyer.
“I happen to be from Bollywood. I went on an invitation, refused when asked if I have drugs. They were honest not to accuse me of anything else. Data from my mobile has been retrieved and sent for forensics,” he said
“Search and seizure can not be cited just to lock me up in the jail,” he added, as reported by Livelaw.
Notably, a metropolitan magistrate court on Thursday rejected further NCB Custody of Aryan, actor Arbaaz Merchant and model Munmun Dhamecha and other accused in the case and instead remanded them to 14-day judicial custody.
Citing Rhea Chakraborty’s bail order, Additional Solicitor General Anil Singh said that all offences under NDPS Act are non-bailable. Rhea’s judgment would have precedence over Stefan Mueller’s judgment as it’s the latest order, he said.
“What will have to be considered is how influential the people are…there is a chance of tampering. Singh says that this is not an isolated case and any sort of protection in the nature of bail would hamper the investigation,” he added.
Maneshinde cited the case of Kaizan, who was arrested along with Rhea, and granted bail on the same day as the prosecution did not object.
