Mumbai: Esplanade magistrate court here on Friday rejected bail applications of Aryan Khan, son of actor Shahrukh Khan, actor Arbaaz Merchant and model Munmun Dhamecha in the drugs-on-cruise case.
Additional Metropolitan Magistrate RM Nilekar observed that the bail pleas are not maintainable.
Appearing for the Narcotics Control Bureau, Additional Solicitor General Anil Singh argued that the offences against the accused are exclusively triable by the Special Court of Sessions under the NDPS Act, not a magisterial court, Livelaw reported.
Citing Rhea Chakraborty’s bail order, Singh said that all offences under NDPS Act are non-bailable. Rhea’s judgment would have precedence over Stefan Mueller’s judgment as it’s the latest order, he said.
“What will have to be considered is how influential the people are…there is a chance of tampering. Singh says that this is not an isolated case and any sort of protection in the nature of bail would hamper the investigation,” he added.

Notably, the magistrate court on Thursday rejected further NCB Custody of Aryan, actor Arbaaz Merchant and model Munmun Dhamecha and other accused in the case and instead remanded them to 14-day judicial custody.
