Lucknow: The notice sent to the anti-CAA protesters seeking to recover damages has been withdrawn by the Uttar Pradesh government.

The decision came after Supreme Court pointed out last week that the state may have overreached itself by announcing to seize properties of those who were involved in December 2019 protests against the Citizenship Amendment Act (CAA).

“The state government has withdrawn the notices for the recovery of damages,” a senior officer was quoted as saying by news agency IANS.

Officials said that additional district magistrates (ADMs), who was at the helm of the recovery claims tribunals in districts, released 274 notices for recovery of damages, including 95 issued to protesters in Lucknow.

The Supreme Court observed on February 11 that Uttar Pradesh had not followed due process.

“You have become complainant; you have become witness; you have become prosecutor… and then you attach properties of people. Is it permissible under any law?” a bench comprising Justice Dhananjaya Y Chandrachud and Justice Surya Kant had asked the law officer of the state government.
