Pari Murder Case: Accused Refuses Brain Mapping, Victim’s Mother Moves SC For CBI Probe

Nayagarh: The minor boy, who has been arrested in connection with the murder of a 5-year-old girl of Jadupur village in Nayagarh district, on Wednesday refused to undergo the brain mapping.

The Crime Branch Special Investigation Team (SIT) led by senior IPS officer Arun Bothra had arrested the minor accused.

It may be recalled that Special POSCO Court had on January 8 rejected the appeal of SIT for Narco test as the accused refused to undergo the test. The POCSO court has referred the case to JJB after taking note that the accused is a minor on the basis of his date of birth in his Matriculation certificate.

Acting on the directive of the court, the SIT on the same day had produced the minor accused in JJB and prayed for Narco test. But, as the accused expressed his unwillingness in writing, the JJB rejected the Narco test. Later, SIT sought the permission for brain mapping of the juvenile accused to which the Board postponed its hearing to January 13.

It is worthwhile to mention here that a three-judge bench of the Supreme Court headed by Chief Justice KG Balakrishnan in a ruling on May 19, 2010, had said that so-called Narco analysis, brain mapping and polygraph tests cannot be conducted on any person without their consent. Such procedures are illegal and a violation of personal liberty.

The order of the apex court had come in response to petitions questioning the validity of such tests that were filed by persons accused in various criminal cases.

Meanwhile, Soudamini Sahu, mother of the deceased minor girl on Wednesday moved the Supreme Court seeking a CBI probe into the murder of her daughter.
