Mumbai: All eyes are on the bail hearing of Aryan Khan, Arbaaz Merchantt and Munmum Dhamecha, which is underway at Bombay High Court in connection with the cruise ship drugs bust case.
The case is being heard by a single-judge bench of Justice Nitin W Sambre.
The defence lawyers have been arguing in favour of the star kid and others for the last two days. Additional Solicitor General (ASG) Anil Singh, representing NCB, said both Aryan Khan and Arbaaz Merchant are regular consumers of drugs. “The arrest memo mentions commercial quantity,” he said.
Stating that this is a heinous crime, Singh said that bail is an exception under Narcotic Drugs and Psychotropic Substances (NDPS) Act. “Aryan was aware that Arbaaz was in possession. Charas was for smoking and it was for the consumption of both though it was with Arbaaz physically,” he said.
The NCB has accused Aryan of buying drugs and said that he shouldn’t have done this on Gandhi Jayanti.
On defence’s reference to Tofan Singh case, the ASG said that it does not apply before trial. He instead cited Ratan Malik judgment in which the person was not found with drugs.
The three were denied bail on Wednesday and if they do not manage to get it by Friday then the accused in the drugs bust case will have to stay in jail till November 15 as the court will remain closed for Diwali vacation from November 1.
The vacations will continue till November 12. The court will also remain closed on November 13 and 14 (Saturday and Sunday).

Aryan Khan has been in jail since October 8. He was arrested after drug raids on a cruise ship party on October 2 by the NCB. Aryan Khan has been denied bail twice before. The special anti-drugs court that denied him bail last week said he knew about charas hidden in his friend Arbaaz Merchant’s shoe, and this amounted to “conscious possession”. Arbaaz Merchant was also arrested along with Aryan and 18 others.
