11-Year Old Boy Appears At His Own Murder Case Hearing In Supreme Court

New Delhi: An 11-year-old boy from Uttar Pradesh’s Pilibhit appeared before a division bench of the Supreme Court and claimed that the  case regarding him being heard for his murder was a false one. The SC was hearing a special leave petition when the boy said that his father had falsely framed his grandfather and uncles in his murder case.

The apex court issued notices to the Government of Uttar Pradesh, Superintendent of Police at Pilibhit as well as to the station house officer of Neuria police station. “No coercive steps shall be taken against the petitioners till further orders,” the SC said while accepting the petition.

Speaking with Times of India, Kuldeep Jauhari, who was representing the boy at court said that the boy was living with his maternal grandfather, a farmer, since February 2013. His mother was brutally beaten to death by his father demanding more dowry from her family.

The lawyer, Jauhari further said, “The boy’s mother who married in February 2010, succumbed to her injuries due to the beating in March 2013.”

As per aTOI report, an FIR under IPC Section 304-B (dowry death) was lodged by the boy’s maternal grandfather against his father.

However the latter demanded his son’s custody which eventually led to a legal battle between the two sides.

Earlier this year, the boy’s father accused the grandfather and his four sons of the boy’s murder. Jauhari said that the father filed an FIR following which the boy’s grandfather and uncles were booked by police under Sections 302 (murder), 504 (intentional insult) and 506 (criminal intimidation) of the IPC, TOI reported.

Jauhari also said that the grandfather and his sons approached the Allahabad High Court for quashing the FIR but the court dismissed their plea due to which they had to appear in the SC.

The matter will now be heard in January 2024, the legal counsel added.
