Mumbai: The Bangladeshi national who was arrested for allegedly stabbing Bollywood actor Saif Ali Khan at his Bandra home earlier this year has claimed in his bail application that a false case was registered against him.
Mohammad Shariful Islam Shehzad, the 30-year-old accused, pleaded before the sessions court that the “First information report is patently false and a false case has been registered against him,” reported PTI.
Saif was stabbed multiple times with a knife by the intruder in his 12th-floor apartment in the early hours of January 16.
Two days after the 54-year-old actor underwent an emergency surgery at Lilavati Hospital, police arrested Shariful.
The accused said in his plea that his arrest was illegal as the investigating agency had “clearly and blatantly disregarded” section 47 of Bharatiya Nagarik Suraksha Sanhita (BNSS), which pertains to informing a person about the grounds of his arrest and right to bail.
The petition further stated that even if the statements of witnesses are taken as gospel truth, without admitting anything on record, for the sake of argument, it won’t be able to fulfil the ingredient of BNS section 311 (robbery or dacoity committed with the intent to cause death or grievous hurt).
Stating that the accused has cooperated with the investigation, the petition submitted that “no useful purpose will be served by detaining him further in custody”.
The plea will be heard on April 1.
