New Delhi: Union Home Secretary Govind Mohan has tendered an unconditional and unqualified apology to the Supreme Court in a contempt case over the alleged violation of its order that Metro and train services in Delhi should not be completely stopped during the Cockroach Janta Party’s October 10 protest, PTI reported.

In his affidavit before the top court, Mohan stated that Delhi Police had approached the authorities seeking a one-day halt to cellular internet services, with the restriction to remain in force until 10 pm on October 10. He maintained that the proposal was examined legally and accepted as proportionate, considering the scale of the situation and the requirement to safeguard public order in the capital.

Limited Shutdown, Says Centre

The home secretary informed the court that mobile internet remained suspended between 10 pm on October 9 and 10 pm on October 10 in an area extending four kilometres from Raisina Hill. He emphasised that the action was restricted to cellular internet and did not affect non-cellular internet services or communication facilities such as Wi-Fi and broadband.

“The request was duly processed and considered in accordance with law and was found to be a proportionate measure, having regard to the magnitude of the situation and the need to prevent any disturbance of public order in the national capital,” Mohan said.

“I state and submit that the suspension of internet services for a limited period and within a defined geographical area, subject to the applicable statutory safeguards, is a recognised measure that may be considered for maintaining public order in appropriate circumstances,” he added.

Court Order Under Challenge

Mohan requested the Supreme Court to amend its October 11 order to the extent required to allow internet suspensions where necessary, provided such action remains within the legal framework and complies with statutory safeguards.

“I therefore respectfully pray that this court may be pleased to modify its order dated October 11 to the extent necessary to permit the suspension of internet services in situations of necessity, strictly in accordance with law and subject to the applicable statutory requirements and safeguards,” he said.

Chief Justice Surya Kant and Justice Joymalya Bagchi are set to take up the matter on Thursday.

Notices Over Transport Curbs

On October 11, the Supreme Court said the petitioners had made out a prima facie case that its order against a complete shutdown of Delhi Metro and railway services was violated. It then issued notices to Union Home Secretary Govind Mohan, Delhi Police Commissioner Anurag Kumar and DMRC chairperson D Thara.

The CJP had announced the October 10 demonstration to press for the resignation of Chief Election Commissioner Gyanesh Kumar, citing alleged irregularities in electoral processes.
